1. About These Terms
These Terms and Conditions govern the use of this website and the provision of landscaping services by MARBLE CONTRACTORS LTD, company number 14762741, whose registered office is at First Floor, Swan Buildings, 20 Swan Street, Manchester, England, M4 5JW.
By using this website or engaging our services, you acknowledge that you have read and understood these Terms and Conditions.
2. Our Services
MARBLE CONTRACTORS LTD provides landscaping services including, but not limited to:

  • Landscape design and build

  • Patios and paving

  • Driveway installation

  • Grounds maintenance

  • Fencing and boundaries

  • Turfing and lawn care

  • Planting and garden enhancements

The exact scope of any project will be confirmed in the quotation, estimate, specification or other written agreement provided to the customer.
3. Quotations and Estimates
All quotations are based on the information available to us at the time of preparation.
Unless otherwise stated in writing, quotations are valid for the period specified on the quotation. We reserve the right to amend a quotation where circumstances change before work begins.
A quotation may need to be revised where additional work, materials or labour become necessary due to circumstances that could not reasonably have been identified when the original quotation was prepared.
No additional work will normally be undertaken without the customer's agreement, except where immediate action is reasonably necessary to protect the property, people or completed works.
4. Acceptance of Work
A quotation or proposal is accepted when the customer confirms their agreement in writing, electronically, verbally where appropriate, or by making a payment requested in connection with the project.
Acceptance of a quotation constitutes agreement to these Terms and Conditions unless alternative written terms have been expressly agreed.
5. Deposits and Payments
Where a deposit is required, the amount and payment deadline will be stated in the quotation or invoice.
The remaining balance will become due in accordance with the payment terms provided to the customer.
Invoices must be paid by the stated due date.
We reserve the right to suspend or delay work where payments are overdue.
Where a project is divided into stages, payment may be required at agreed stages throughout the project.
6. Changes to the Project
Customers may request changes to the agreed specification.
Any changes that affect the cost, materials, labour or completion time may result in an additional charge.
Where reasonably possible, the cost of significant changes will be confirmed before the additional work is undertaken.
Changes requested after materials have been ordered or work has commenced may result in additional costs.
7. Site Conditions and Unforeseen Work
Landscaping projects can involve conditions that cannot always be identified before work begins.
These may include hidden drainage, underground services, unsuitable ground conditions, buried materials, unexpected foundations, contaminated soil, tree roots, difficult access or other unforeseen circumstances.
Where such conditions require additional work or materials, we will discuss the situation with the customer and agree any additional costs where reasonably practicable before proceeding.
8. Materials
Materials will generally be selected in accordance with the agreed quotation or specification.
Natural materials such as stone, timber and plants may vary in colour, texture, size and appearance. Such variations are not necessarily defects.
Where customers supply their own materials, we cannot guarantee their suitability, quality or compatibility with the proposed works.
9. Access to the Property
The customer is responsible for providing reasonable access to the property and work area during agreed working hours.
The customer should inform us of any restrictions, access requirements, parking limitations or other site conditions that may affect the project.
Where restricted or unsuitable access causes additional labour, transportation or equipment costs, these may be chargeable to the customer.
10. Existing Services and Utilities
The customer should provide information about known underground or concealed services, including drainage, electricity, water, gas, telecommunications and irrigation systems.
Although reasonable care will be taken during the works, we cannot accept responsibility for damage to services that were concealed, incorrectly positioned or not reasonably identifiable before work commenced.
11. Project Timescales
Any estimated start or completion dates provided are approximate unless expressly agreed otherwise in writing.
Weather conditions, availability of materials, supplier delays, unforeseen site conditions, changes requested by the customer and other circumstances outside our reasonable control may affect project timescales.
We will make reasonable efforts to keep customers informed of significant delays.
12. Workmanship
We aim to complete all work to a professional standard and in accordance with the agreed specification.
If a customer believes that work has not been completed in accordance with the agreed requirements, they should notify us promptly so that we have a reasonable opportunity to inspect the work and, where appropriate, remedy the issue.
13. Customer Responsibilities
The customer is responsible for:

  • Providing accurate information about the property and project.

  • Providing reasonable access to the site.

  • Obtaining any permissions that are specifically the customer's responsibility.

  • Informing us of known restrictions, hazards or underground services.

  • Making payments by the agreed deadlines.

  • Removing or protecting personal belongings where necessary.

14. Planning Permission and Other Permissions
Where planning permission, building regulations approval, landlord consent, conservation area consent or other permissions are required, responsibility for obtaining those permissions will be agreed with the customer before work begins.
The customer remains responsible for ensuring that any permissions specifically required from them have been obtained unless we have expressly agreed in writing to obtain them on their behalf.
15. Plants and Natural Landscaping
Plants, lawns and other living landscaping materials are subject to weather, soil conditions, pests, disease and ongoing maintenance.
We cannot guarantee the long-term survival of plants, turf or other living materials where their condition is affected by circumstances outside our control or where appropriate aftercare has not been provided.
Any specific guarantees relating to planting or turf will be confirmed separately in writing.
16. Grounds Maintenance
Where we provide ongoing grounds maintenance, the services included, frequency of visits and associated charges will be agreed with the customer.
Additional work outside the agreed maintenance specification may be charged separately.
The customer may be required to provide reasonable access to the property on scheduled maintenance dates.
17. Cancellation
Cancellation rights and any applicable charges will depend on the nature of the contract and the stage reached when cancellation occurs.
Where the customer cancels after materials have been purchased, bespoke items have been ordered, labour has been allocated or work has commenced, reasonable costs already incurred may be payable, subject to applicable consumer law.
Where consumer cancellation rights apply, nothing in these Terms and Conditions is intended to remove or restrict those rights.
18. Consumer Rights
If you are a consumer, you have statutory rights under applicable UK consumer protection legislation.
Nothing in these Terms and Conditions is intended to exclude or limit any legal rights that cannot lawfully be excluded or limited.
Where services are supplied to consumers, applicable legislation may provide rights relating to reasonable care and skill, conformity with agreed requirements and other protections.
19. Damage and Liability
We will take reasonable care while carrying out work at a customer's property.
We will not be responsible for loss or damage caused by circumstances outside our reasonable control or by pre-existing defects, concealed conditions or information that was not disclosed to us.
Nothing in these Terms and Conditions excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence or for fraud or fraudulent misrepresentation.
20. Photographs and Completed Projects
We may request permission to photograph completed landscaping projects for portfolio, website and marketing purposes.
We will only use identifiable images of a customer's property for marketing purposes where appropriate permission has been obtained.
21. Website Content
We aim to ensure that information displayed on this website is accurate and up to date.
However, photographs, descriptions, examples and other website content are provided for general information and may not represent the exact materials, finishes or results available for every project.
We reserve the right to update, amend or remove website content without notice.
22. Intellectual Property
Unless otherwise stated, all content on this website, including text, graphics, photographs, branding, logos and design elements, belongs to MARBLE CONTRACTORS LTD or is used with appropriate permission.
Website content must not be copied, reproduced, distributed or commercially used without prior written permission.
